Samantha Riggs (instructed by Pannone) successfully judicially reviews the Regional Asset Recovery Team (RART) resulting in search warrant being quashed

The search warrant & subsequent search and seizure was declared unlawful because the search warrant failed to comply with section 8 & 15 of PACE and the search based upon the warrant failed to comply with section 15 (6) (b) PACE. Material seized during the dawn raids carried out by RART and the Environment Agency (EA) was ordered to be returned (including any copies). The Court also ordered the destruction of any reports containing any material unlawfully seized during the search. The challenges brought by the claimant as to the warrant and Information could not be described as technical challenges but went to the substance of the application. The absence of identified information served to undermine the decision of the justices.
